A group of file-sharing activists is practicing a little civil disobedience of its own in order to bring the documentary series Eyes on the Prize to a wider audience.

As Wired News first reported, Eyes on the Prize, the 14-part series chronicling the civil rights movement, can no longer be broadcast on television and has never been released on DVD because of copyright restrictions.
The series combines archival footage like newsreel clips, photographs and songs from many different sources and is considered 'the principal film account of the most important American social justice movement of the 20th century,' according to Clayborne Carson, a Stanford University history professor and editor of Martin Luther King Jr.'s papers. Licensing agreements for some of the material used in the series were granted for a set number of years, and have since expired. Blackside, the production company, is in the process of determining the cost to re-clear the rights.

Old VHS tapes that remain in schools and libraries were the only way to view the landmark series, until now. Downhill Battle enlisted the help of a group called Common Sense Releasers to digitize the series and convert it to MPEG-4 format for distribution on the internet. The group hopes people will organize community screenings of the series around the country.

'We're just making sure that everyone who wants access to Eyes on the Prize has access to Eyes on the Prize,' said Tiffiniy Cheng, co-director of Downhill Battle, which is encouraging people to view the film Feb. 8 in honor of Black History Month. 'We're hoping there will be screenings in every major city.'
People can download the first three parts using Blog Torrent now, and the remaining parts will be posted on the website in the next few days.
Cheng believes the group has a fair-use right to do this because the historically important film is otherwise unavailable. She added that Downhill Battle will solicit donations for Blackside as well.
But Sandy Forman, a lawyer for Blackside and director of the project to re-license the lapsed footage, said Downhill Battle has 'no fair-use claim to do this whatsoever.'
'We are going to pursue any and all legal remedies available to stop this as soon as possible,' Forman said. 'Clearly we agree that it's very important to have (Eyes on the Prize) out there but certainly the way these people are going about it is completely unacceptable and illegal.'
She said Blackside does not endorse what Downhill Battle is doing, and the late Henry Hampton – the filmmaker who founded Blackside and produced Eyes on the Prize – 'would absolutely not support this.'
One civil rights activist is supportive of the project.
Lawrence Guyot, former leader of the Mississippi Freedom Democratic Party, plans to organize a screening in Washington, D.C. He said that Downhill Battle's reaction is 'precisely what is needed.'
'If people had stuck to the law, black people wouldn't have the right to use restaurants and hotels. If people had stuck to the law, women wouldn't have the right to vote. If people had stuck to the law, women wouldn't have the right to own property,' Guyot said. 'Our country has a history of laws that we are very proud we have moved away from.'
Guyot said that the series is important because it shows 'the power of ordinary people to get civically engaged and make policy changes.' That's a crucial message for young people, in particular, to hear, he said.
'Now is the time to fight through the miasma of who owns Eyes on the Prize,' Guyot said.
